Welcome to YES Inc. (the “Platform”). The Platform is provided and controlled by YES Inc. (“YES Inc.”, “we” or “us”). Your privacy is a significant responsibility at YES Inc. This Privacy Policy covers the experience we provide for users age 18 and over on our Platform.

This privacy statement is valid for all YES Inc. branded websites, apps, events, and other services. We will refer to all of these in this Privacy Policy as “services.”

Certain services need their own particular privacy policy. If a service has a privacy policy of its own, that policy will take precedence over this Privacy Policy.

INFORMATION WE COLLECT ABOUT YOU

The information we collect is detailed and allows us to provide you with a personalized experience. We also use this data for security purposes, as well as tracking user trends so that our services can improve over time. Information you choose to provide includes:

  • Registration information, such as age, username and password, language, and email or phone number
  • Profile information, such as name, social media account information, and profile image

Surveys: By giving us your insights, responses to our questions and testimonials, you help ensure the products we develop are tailor-made for users like you.

Social Media: If you choose to link or sign up using your social network (such as Facebook, Twitter Instagram, or Google), we will collect any contact lists for these services and related data on our platform that is associated with your use of them.

Users: Other users of the Platform may provide us information about you, including customer service inquires and chat messages.

Affiliates/Partners: YES Inc. ads may be published on a partner’s service, in which case they will pass along details of the campaign’s success. We also receive information about bad actors from third parties as part our efforts to ensure users’ safety and security.

Other Sources. We may collect information about you from other publicly available sources.

Information We Collect Automatically: The Platform automatically receives and stores certain information from you when using our services, including internet or other network activity data such as your IP address. We also collect geolocation-related info about the device on which it’s installed – this includes things like where it’s located in terms of geographical coordinates (latitude and longitude), what kind of smartphone/tablet or other device, and any browsing history found during searches conducted via these devices.

Usage Information: The data we collect about your activity on our services. For instance, exchanges with other users in chats and interests in dates. The numbers of exchanges and number of messages sent and received.

Device Information: We collect information about the device you use to access our services, including hardware and software details such as IP address. We also could collect device ID, app settings, app crashes, advertising IDs (randomly generated), identifiers associated with cookies, and other technologies that may uniquely identify a device or browser.

Permission-Based Information: By giving us permission, you allow the collection of your precise geolocation (latitude and longitude). The information may be collected in background even when using our services unless otherwise stated. If permission is declined, no collection will take place.

Messages: When you communicate with other users through our messaging app, we collect and process your information. This includes the content of messages as well as when they were sent or received – all of this helps us improve how people interact.

Metadata: When you upload User Content, the system automatically records certain metadata that is connected to you. Metadata describes other data and provides information about your User Content that will not always be evident to the viewer.

COOKIES AND OTHER SIMILAR DATA COLLECTION TECHNOLOGIES

We and our service providers and business partners use cookies and other similar technologies (e.g., web beacons, flash cookies, etc.) (“Cookies”) to automatically collect information, measure and analyze which web pages you click on and how you use the Platform, enhance your experience using the Platform, improve the Platform, and provide you with targeted advertising on the Platform and elsewhere across your different devices. Cookies are small files which, when placed on your device, enable the Platform to provide certain features and functionality. Web beacons are very small images or small pieces of data embedded in images, also known as “pixel tags” or “clear GIFs,” that can recognize Cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. Additionally, we allow these service providers and business partners to collect information about your online activities through Cookies. We and our service providers and business partners link your contact or subscriber information with your activity on our Platform across all your devices, using your email or other log-in or device information. Our service providers and business partners may use this information to display advertisements on our Platform and elsewhere online and across your devices tailored to your interests, preferences, and characteristics. We are not responsible for the privacy practices of these service providers and business partners, and the information practices of these service providers and business partners are not covered by this Privacy Policy.

We may aggregate or de-identify the information described above. Aggregated or de-identified data is not subject to this Privacy Policy.

We and others may use cookies, pixels, SDKs to recognize you or your device. Learn more about how we use them in our Cookie Policy.

The “Do Not Track” (DNT) feature of some web browsers is designed to prevent website tracking. YES Inc. does not currently respond to DNT signals.

HOW WE USE YOUR INFORMATION

We are committed to providing you with the best experience possible. This includes making sure your personal information is safe and used only as necessary. Here are some examples of how your personal information might be used:

  • to fulfill requests for products, services, Platform functionality, support, and information for internal operations, including troubleshooting, data analysis, testing, research, statistical, and survey purposes and to solicit your feedback
  • to customize the content you see when you use the Platform – for example, to show you content that is similar to content that you already liked or interacted with
  • to send promotional materials from us or on behalf of our affiliates and trusted third parties
  • to improve and develop our Platform and conduct product development

HOW WE SHARE YOUR INFORMATION

You can rest assured that your personal information will not be sold or released to anyone outside of YES Inc. However, in order for us to maintain an effective service and provide you with relevant matches as well as helpful features such as chat rooms, it is necessary for us at times to share certain details about our users which may include things such as basic contact info (e-mail address) or information such as height/weight measurements, etc.

With Service Providers and Business Partners

We share some of the items listed above with service providers and business partners so they can perform their functions, including research for us to improve our products/services and for payment processing such as credit card payments or e-wallets (Apple Pay, for example).

With Members of Our Corporate Group

We may share your information with a parent, subsidiary, or other affiliate of our corporate group.

In Connection with a Sale, Merger, or Other Business Transfer

We may share your information in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, asset sale, or in the unlikely event of bankruptcy.

For Legal Reasons

We may share your information with other companies and organizations for various reasons including but not limited to: responding to subpoenas, court orders, or legal process; protecting the rights of YES Inc. and its affiliates/users/customers in general (e.g., privacy); or exercising our legal right(s).

With Your Consent

We may share information for other purposes pursuant to your consent or with your further direction.

In accordance with their privacy policies, third-party services such as Facebook, Google, and Twitter may be able to collect information about you, including information about your activity on the Platform, if you use them to access the Platform or to share information about your usage with others. They may also inform your connections on the third-party services about your use of the Platform.

You should be aware that any information you share if you choose to participate in public activities on the Platform could be read, collected, or utilized by other users. When engaging, you ought to use caution in giving personal information. The data you decide to submit is not our responsibility.

Your Rights

By contacting us by email or by postal mail at the physical address listed in the Contact section at the bottom of this policy, you can request access to or deletion of the information we have gathered about you. Upon sufficient verification and in accordance with the current law, we will react to your request. Additionally, we don’t penalize anyone for exercising their privacy rights.

Your Choices

  • By modifying the settings of your browser, you might be able to reject or disable Cookies. Please refer to the instructions supplied by your browser, as each browser is unique. Please be aware that in order to reject or disable particular Cookie types, you might need to take extra measures. You may need to take different actions, for instance, to disable targeted advertising for a mobile application and to disable Cookies used for targeted advertising in a browser, which you can control through your device settings or mobile app permissions. This is because browsers and mobile apps operate differently.
  • Your mobile device may include a feature that allows you to opt out of some types of targeted advertising (“Limit Ad Tracking” on iOS and “Opt out of Interest-Based Ads” on Android).
  • You can opt out of marketing or advertising emails by utilizing the “unsubscribe” link or mechanism noted in marketing or advertising emails.
  • If you do not want to exchange GPS information, you can turn off the GPS location information capabilities on your mobile device.
  • By logging into your account and using the services and functions offered, you can access, review, and update some of the personal information you have submitted to us if you have registered for an account.
  • Websites may receive “do-not-track” signals from some browsers. It is sometimes unclear whether users desire for these signals to be communicated or whether they are even aware of them due to variances in how browsers incorporate and activate this capability. Currently, we don’t react to these signals in any way.

Security

We take precautions that are appropriate in the circumstances to help safeguard information against misuse, loss, theft, unauthorized access, disclosure, modification, and destruction. You should be aware that no method of data storage or transfer over a public network, including the Internet, can be completely guaranteed to be safe. Note that we are not liable for ensuring the security of information gathered by third parties, which might not be subject to the same security safeguards as the information you provide to us.

Children

Children under the age of 18 are not intended for the Platform. If we learn that a person under the age of 18 has their personal information gathered on the Platform, we will erase that information and deactivate the user’s account. OTHER RIGHTS

California Residents

If you live in California, you may be entitled to information once a year regarding the personal data that we have shared, if any, with other companies for their own direct marketing purposes. The types of customer information as well as the names and addresses of the companies with whom we shared customer information during the just-concluded calendar year would be included, if appropriate, in this information. CONTENT REMOVAL FOR USERS UNDER 18

California residents who are under 18 years old may request and seek the removal of any User Content they have put on the Platform. California Removal Request must be the subject line of every request. All requests must include a description of the user content that should be deleted, together with information that will allow us to find it.

California Removal Requests cannot be submitted by phone, fax, or postal mail. We may not be able to react if you do not provide sufficient information, and we are not responsible for notices that are not properly labeled or distributed. Please be aware that your request does not guarantee the material will be completely removed. For example, materials that you have posted may be republished or reposted by another user or third party.

Changes

We might occasionally change our privacy statement. The “Last Updated” date at the top of this policy will be updated, the new Privacy Policy will be posted, and we’ll also give you any other notices mandated by applicable legislation. To keep up with our privacy policies, we advise you to read the Privacy Policy each time you use the Platform.

HOW LONG WE RETAIN YOUR INFORMATION

We only preserve your personal information as long as necessary for those legitimate business goals (described in HOW WE USE YOUR INFORMATION) and as long as doing so is allowed by the law. You can close your account and your profile will no longer be viewable to other users if you decide not to use our services anymore. We will remove your personal data if your account is closed, as detailed below:

We employ a safety retention window of three months after account deletion in order to preserve the security and safety of our users. We retain your information during this time in case it becomes essential to look into any potentially damaging or illegal activities. Our legitimate interests and the interests of potential third-party victims are the foundation for the retention of information throughout this safety retention window.

Once the safety retention window elapses, we delete your data and only keep limited information for specified purposes, as laid out below:

We maintain limited data to comply with legal data retention obligations: in particular, we keep transaction data for 10 years to comply with tax and accounting legal requirements. We may also need to keep “traffic data”/logs for one year to comply with legal data retention obligations. We also keep records of consent given to us by users for five years to evidence our compliance with applicable law.

For the purposes of enforcing our rights and enabling us to defend ourselves in the event of a claim, we maintain limited information. We keep customer care records and supporting data as well as vague download/purchase location data, profile data in anticipation of potential litigation, for the establishment, exercise, or defense of legal claims, and data necessary to prevent users who were banned or people who were found to be under the age of 18 from opening a new account, to ensure the safety and vital interests of our users.

A valid legal subpoena or request asking us to preserve data (in which case we would need to keep the data to comply with our legal obligations) or if data would otherwise be required as part of legal proceedings are examples of situations in which we maintain information on the basis of our legitimate interest.

JOB CANDIDATES, CONTRACTORS, AND VENDOR REPRESENTATIVES

As part of our hiring and talent management processes, as well as our administration of the services that vendors and contractors render to us, we also process the personal information of our job candidates, contractors, and vendor representatives. The sections of this privacy statement that address the entity in charge of processing your personal information, transfers of personal information, rights you may have under applicable law, how to contact us, and California-specific information all apply to the processing of your personal information if you are a job applicant, contractor, or vendor representative of YES Inc.

If you are a job applicant, the personal information we handle about you may change depending on the position you are seeking, but it typically consists of the data you submit with your job application as well as any professional qualifications, background information, and references that recruiters or other third parties share with us. The recruitment process, which could result in an employment contract, is supported by this data. In order to manage our relationship with contractors and vendor representatives, which is necessary for the implementation of the services agreement, and to establish, exercise, or defend prospective legal claims, we may process identifying information and work-related information.
